Contrary to the popular myth, bankruptcy is usually not caused by people living extravagantly outside of their means. It is much more likely that a prolonged illness, costly divorce, or difficult career transition will be the cause. At Cushner & Garvey LLP, we believe that bankruptcy is a humane way to allow debtors to get out of debt and back on their feet. We know that you are a conscientious person. We know that you want to meet your obligations. As a member of the National Association of Consumer Bankruptcy Attorneys, we can help you put your debt crisis behind you. Call Cushner & Garvey LLP today to find out how.

Should I Declare Bankruptcy?

You should, if you

  • Feel overwhelmed by an enormous hospital bill
  • Receive harassing phone calls from collectors every day
  • Are threatened by foreclosure or had your car repossessed

Bankruptcy might then be a viable option for you.

The Two Bankruptcies

There are two types of consumer bankruptcy. Chapter 7 bankruptcy is a great opportunity for consumers to pull themselves out of debt. It involves selling your assets to pay for your creditors. Not all your assets are sold--your home and auto are almost always exempt. In a chapter 7 bankruptcy, a consumer is usually relieved of all his debt.

If you are ineligible for a Chapter 7, or you have assets you wish to protect, a Chapter 13 bankruptcy may be a better option. A Chapter 13 allows to you create a no-interest payment plan to pay part or all of what you owe.

Whatever form of bankruptcy you choose, we can walk you through the process. A court appearance is rarely necessary. If there is one, we represent you.

There is no reason to be overwhelmed by debt. There are other options. With our extensive finance experience, we can help you choose the path that will make you solvent again.
